These Terms of Service apply to services provided by Nomadic Solutions LLC, a Texas limited liability company, through nomadicsolutionstx.com and related communications.
1. Services
Nomadic Solutions provides small business website design, website setup, managed hosting, business email setup, basic maintenance, update help, and related services. The exact work for a project is the work described in the accepted quote, invoice, written proposal, or service agreement.
2. Quotes and Scope
Package pricing includes only the pages, features, revisions, and support listed for that package or agreed in writing. Extra pages, major changes, new features, copywriting from scratch, migrations, complex forms, ecommerce, booking tools, member areas, and other work outside the agreed scope may be quoted separately or billed hourly.
3. Client Responsibilities
You are responsible for providing accurate business information, approved text, images, logos, account access, domain access, and timely feedback. You confirm that you have the right to use all content, photos, logos, names, trademarks, and materials you provide.
4. Payment
Most website projects require a deposit before work begins and final payment before the site goes online. Monthly hosting, email, and update plans are billed in advance. Unpaid invoices may pause work, updates, support, launch, hosting changes, email changes, or handoff assistance.
For hosted websites, business email, and other ongoing services, unpaid invoices may result in suspension or termination of service. This may include taking a hosted website offline, disabling email accounts, stopping DNS or hosting changes, and ending support. You are responsible for keeping billing current if you want hosted services and email service to continue without interruption.
5. Revisions and Approvals
Revision rounds are limited to the number included in the package or quote. Revisions should be sent as organized feedback. A request that changes the approved direction, adds new pages, adds new features, or replaces large amounts of content may be treated as extra work.
6. Domains and Ownership
You should own and control your domain name. Nomadic Solutions may help connect, configure, or manage a domain for you, but domain ownership should remain in your account unless a separate written arrangement says otherwise.
7. Website Ownership
After all invoices for the project are paid, you own the final website files created specifically for your project, along with the business content and assets you provided. Nomadic Solutions keeps ownership of internal tools, reusable code, templates, processes, unused concepts, and general know-how.
8. Hosting and Email
Hosting and email services are subject to the Acceptable Use Policy and Service Policies. Hosting and email are not sold as unlimited services. Storage, mailbox counts, support time, and usage limits may apply based on the plan purchased.
9. Third-Party Services
Some services depend on third parties such as domain registrars, DNS providers, website hosts, email providers, form providers, analytics providers, payment processors, Google, Microsoft, and other tools. Nomadic Solutions is not responsible for outages, pricing changes, policy changes, account suspensions, data loss, or service issues caused by third-party providers.
10. Search Rankings and Results
Nomadic Solutions may set up basic page titles, descriptions, structure, and other ordinary website details, but does not guarantee Google ranking, traffic, leads, sales, revenue, reviews, or business results.
11. Security
Nomadic Solutions uses reasonable care for website setup, hosting configuration, and account access. No website, email service, or online system can be guaranteed to be completely secure or uninterrupted.
12. Cancellations and Refunds
Deposits and paid work are generally non-refundable once work has started. If a project is cancelled, you are responsible for work already completed, third-party costs, and any unpaid invoices. Monthly services may be cancelled before the next billing period unless a written agreement says otherwise.
13. Suspension or Refusal of Service
Nomadic Solutions may refuse, suspend, terminate, or stop services for nonpayment, abusive behavior, unlawful activity, security risk, spam, policy violations, or work that is outside the services offered. If ongoing hosting or email service is terminated for nonpayment, data, files, mailboxes, or settings may not be retained indefinitely.
14. Limitation of Liability
To the fullest extent allowed by law, Nomadic Solutions is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages. Total liability for a claim is limited to the amount you paid to Nomadic Solutions for the service giving rise to the claim during the three months before the event.
15. Governing Law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
16. Changes
Nomadic Solutions may update these terms from time to time. The updated version will be posted on this site with a new updated date.
